The trade marks identified below are registered with the UK Intellectual Property Office (IPO) under the Trade Marks Act 1994.

The registered proprietor identified on the IPO registrations is Paul Nigel Cottingham.

Where these marks are used by KaddieIQ Limited, they are used under the authority of the registered proprietor.

Nothing in this notice records or purports to effect a transfer of ownership of any registered trade mark.

2. OWNERSHIP#

The registered trade marks listed above are registered in the name of Paul Nigel Cottingham.

KaddieIQ Limited uses these marks in connection with its business, products, applications and services.

The goodwill arising from authorised commercial use of the marks is to be treated consistently with the rights of the registered proprietor.

Nothing contained on the KaddieIQ Website, within any KaddieIQ application or in any KaddieIQ publication grants ownership of any KaddieIQ trade mark to another person.

3. NO IMPLIED LICENCE#

Access to or use of a KaddieIQ website, application, product or service does not grant you any licence or other right to use a KaddieIQ trade mark.

Except where permitted by law, prior written permission is required before any KaddieIQ registered trade mark is used:

commercially;
in advertising or promotional material;
as part of a business name;
as part of a product or service name;
within a domain name;
within an application name;
within a social-media account name;
on merchandise;
as part of another logo or device mark; or
in any way that suggests sponsorship, endorsement, partnership, authorisation or affiliation with KaddieIQ.

4. PROTECTION OF THE K-LOGO®#

The K-Logo® is protected as a UK registered figurative trade mark under registration number UK00004371046.

Unless specifically authorised, you must not:

reproduce the K-Logo® commercially;
redraw or recreate it;
materially distort it;
remove or add design elements;
incorporate it into another logo;
create a confusingly similar device mark;
use it as your own branding; or
use it in a way that falsely implies an association with KaddieIQ.

Authorised partners must comply with any KaddieIQ brand guidelines supplied to them.

5. USE OF THE WORD MARKS#

The registered word marks include:

KaddieIQ®
ShotIQ®
BallFIT®
KaddieIQ BallFIT®

The commercial capitalisation used by KaddieIQ should be preserved where reasonably practicable.

The marks must not be used in a way that:

causes or is likely to cause confusion;
suggests unauthorised endorsement;
creates an unauthorised derivative brand;
falsely suggests that another product or business originates from KaddieIQ;
takes unfair advantage of the reputation or distinctive character of a registered mark; or
damages the reputation of a KaddieIQ mark.

6. USE OF THE ® SYMBOL#

The ® symbol denotes a registered trade mark.

KaddieIQ uses the ® symbol in relation to the registered UK marks identified in this notice.

The absence of the ® symbol from a particular webpage, graphic, application screen, advertisement, document or other material does not constitute:

abandonment of the trade mark;
a waiver of rights;
consent to third-party use; or
an indication that KaddieIQ or the registered proprietor does not intend to enforce the applicable rights.

7. TERRITORIAL SCOPE#

The registration numbers stated in this notice are United Kingdom trade mark registrations.

This notice does not represent that these marks are registered in every country or territory worldwide.

Trade mark protection outside the United Kingdom may arise from separate registrations, applications, unregistered rights or other applicable laws.

8. FAIR AND REFERENTIAL USE#

Nothing in this notice is intended to prevent lawful and accurate reference to a KaddieIQ product or service.

A third party may refer to a KaddieIQ mark where permitted by law and reasonably necessary to identify the genuine KaddieIQ product or service concerned.

Any such reference must:

be truthful;
be proportionate;
not imply sponsorship or endorsement that does not exist;
not create confusion as to commercial origin; and
not present the KaddieIQ mark as belonging to the third party.

9. PARTNERS, RETAILERS AND GOLF PROFESSIONALS#

A business relationship with KaddieIQ Limited does not by itself give a distributor, retailer, golf club, professional, pro-shop, contractor, developer, supplier or other organisation unrestricted rights to use a KaddieIQ trade mark.

Any permitted use is governed by the relevant written agreement, licence, brand guidelines or specific written authorisation.

When that authority ends, use of the marks must cease except where continued use is permitted by law.

10. DOMAIN NAMES AND DIGITAL IDENTITIES#

Unless authorised in writing, you must not register or use a domain name, social-media name, application identifier, marketplace listing or similar digital identity incorporating:

KaddieIQ;
ShotIQ;
BallFIT;
KaddieIQ BallFIT;
the K-Logo; or
a confusingly similar name or mark

where that use is likely to imply an association with KaddieIQ or the registered proprietor that does not exist.

11. THIRD-PARTY TRADE MARKS#

Names, logos and trade marks belonging to golf manufacturers, golf clubs, technology providers, payment providers and other organisations remain the property of their respective owners.

Their appearance on a KaddieIQ website or within a KaddieIQ product does not itself mean that:

KaddieIQ owns those marks;
the third party owns or controls KaddieIQ; or
sponsorship, endorsement or partnership exists.

Any relationship will be identified separately where appropriate.

12. REPORTING SUSPECTED INFRINGEMENT OR MISUSE#

Suspected unauthorised use, impersonation, counterfeiting or infringement involving a KaddieIQ trade mark may be reported to:
