Privacy Statement

This Privacy Statement explains how KaddieIQ Limited collects, uses and protects personal information when you use the KaddieIQ BallFIT application (“the App”).

It applies to the UK version of the App.

2. OUR APPROACH TO PRIVACY#

KaddieIQ BallFIT has been designed to send as little personal information as possible to KaddieIQ.

In particular:

• you do not need to create an account or give us your name or email address to use the App;
• the answers you give the App (your ball, your distances, what matters to you and similar) stay on your device and are not sent to KaddieIQ;
• we do not currently use advertising networks in the App;
• we do not currently use analytics tools in the App;
• we do not sell your personal information; and
• the App does not currently send you marketing email.

3. INFORMATION WE PROCESS#

The information we process depends on how you use the App.

3.1 Anonymous player identifier#

The first time the App opens with an internet connection, it asks KaddieIQ's player system to create an anonymous player identifier for your device.

The identifier is a random code. It does not contain, and is not created from, your name, email address or anything you type into the App.

We use it so that a subscription you buy can be linked to the right device and restored if you reinstall the App or change phone.

3.2 Your plan and subscription status#

We may keep information recording whether your anonymous player identifier is:

• free; or
• subscribed to BallFIT Premium,

together with relevant dates.

Where you purchase a subscription through the Apple App Store, Apple processes the payment.

KaddieIQ does not receive your payment-card information from Apple.

We, and our subscription-management provider (see section 8), receive the information necessary to know whether your anonymous player identifier is entitled to Premium: for example the product purchased, the dates, whether it is renewing, and Apple's transaction identifiers.

3.3 Your answers and results (stay on your device)#

BallFIT stores the following on your device only:

• the ball you play and the balls it recommends;
• your chosen courses and your home course;
• your carry distances, priorities and swing-speed estimate;
• any optional details you choose to enter, such as handicap index, gender or age range, which are used only to tailor the recommendation;
• your saved fits and history, if you have BallFIT Premium;
• your unit, theme and display preferences; and
• a record of the version of the Terms and Privacy Statement you accepted, the date and time, and your confirmation that you are 16 or over.

This information is held on your device. It is not sent to KaddieIQ and we cannot see it. Deleting the App, or using Erase all my BallFIT data in the App, removes it.

3.4 Email address#

BallFIT does not currently ask for, collect or store your email address on KaddieIQ's servers.

If a screen in the App lets you type an email address, in this version it is saved on your device only.

If we add email sign-in or email messages in a future version, we will update this Privacy Statement and the App Store privacy information before we start, and we will ask for your permission before sending marketing.

4. LOCATION INFORMATION#

4.1 “Courses near me”#

BallFIT uses your location only if you tap “Find courses near me”, and only while you are using the App.

When you do, your current device position is sent to KaddieIQ's backend service so that it can find golf courses near you in the United Kingdom.

The position is used to answer that one request. The App does not save it with your player identifier or with your course history, and our service does not store it.

If you do not allow location, you can still search for your course by typing its name.

4.2 Searching for a course by name#

When you type in the course search box, the text you type is sent to KaddieIQ's backend service to find matching courses.

We do not store what you search for. To protect the service from abuse, the service briefly uses the internet address (IP address) your request came from to limit how many requests one device can make in a short time.

4.3 Weather#

Weather is requested using the location of the selected golf course, not your live personal position.

The course location is rounded to approximately one kilometre before the weather request is made.

KaddieIQ's server requests weather information from MET Norway.

We do not send your anonymous player identifier, your email address or your live personal location to MET Norway for that weather request.

4.4 Typical temperatures#

Typical course temperatures shown by the App are stored within the App. Showing them does not send anything about you anywhere.

5. INFORMATION STORED ON YOUR DEVICE#

In addition to the information in section 3.3, the App may store information locally on your device such as:

• cached or saved weather information;
• the anonymous player identifier and the sign-in token that goes with it; and
• the simple note that tells the App you have already seen the welcome animation.

This local information is used to operate the App.

It is not treated as server-held KaddieIQ data merely because it is stored on your device.

6. SECURITY INFORMATION#

KaddieIQ uses security measures intended to protect the service from automated abuse, including the request limits described in section 4.2.

Our server providers may keep routine technical logs, which can include IP addresses, for security and reliability.

We use this information only for purposes including protecting the service, preventing fraud, misuse and unauthorised access, and maintaining the security and integrity of the App.

Our lawful basis for this processing is our legitimate interest in securing KaddieIQ's systems, users and services.

We do not use this information for advertising or marketing profiling.

7. WHY WE USE YOUR INFORMATION#

We use personal information for the following purposes.

Providing the App#

This includes:

• creating the anonymous player identifier;
• maintaining your plan or entitlement;
• restoring your purchase;
• delivering the course-search, nearby-course and weather functions you ask for; and
• operating App features.

Our principal lawful basis is performance of our contract with you, or taking steps at your request connected with that contract.

App security and preventing abuse#

We process appropriate technical information to protect the App, infrastructure and users.

Our lawful basis is our legitimate interest in maintaining a secure and reliable service and preventing misuse.

Administering purchases#

We process subscription information in order to know what you have bought, to restore it, and to deal with refunds, complaints and legal obligations.

Our lawful basis is performance of our contract with you and, for records we must keep, legal obligation and our legitimate interest in establishing, exercising or defending legal claims.

8. WHO WE USE TO OPERATE THE APP#

KaddieIQ uses third-party service providers to operate parts of the App.

These currently include:

Supabase#

Used for:

• the player database that holds the anonymous player identifier and plan;
• server functions for course search, nearby courses and weather; and
• related backend services.

KaddieIQ's main Supabase application database is configured in the eu-west-1 Ireland region.

RevenueCat#

RevenueCat, Inc. provides the subscription-management service used by the App.

It receives your anonymous player identifier (used as your app user identifier), your purchase and subscription information from Apple, and technical information such as device and App version, so that it can tell the App whether you have Premium. It does not receive your name or email address from us.

RevenueCat is based in the United States. See section 13.

MET Norway#

Used to obtain weather information.

MET Norway receives the rounded location of the selected golf course for the weather request. We do not send your anonymous player identifier or email information to MET Norway as part of that request.

Apple#

Apple may process information where you:

• download the App from the App Store;
• make an Apple In-App Purchase;
• maintain or cancel an App Store subscription; or
• request an App Store refund.

Apple's processing is also governed by Apple's own privacy information and service terms.

9. COURSE AND BALL INFORMATION#

Golf-course names and locations are supplied under licence by GolfAPI.com. Typical temperatures contain modified Copernicus Climate Change Service information.

Ball information is based on information published by golf-ball manufacturers and KaddieIQ's own analysis.

None of this information is used by KaddieIQ to create advertising profiles about you.

10. NO ADVERTISING, ANALYTICS OR SALE OF DATA#

The current KaddieIQ BallFIT build does not:

• contain third-party advertising;
• use advertising networks;
• use behavioural advertising;
• use analytics tools to profile App usage; or
• sell personal information.

If this changes materially in the future, this Privacy Statement and the applicable App Store privacy information must be updated before the new processing is introduced where required.

11. MARKETING EMAIL#

The current App does not send marketing email, and we do not hold an email address for you.

If that changes, marketing will be optional and off by default, creating or using the App will not be treated as consent, and every marketing email will include a way to unsubscribe.

12. CHILDREN AND USERS AGED 16 OR 17#

KaddieIQ BallFIT is not intended for children under 16.

Users aged 16 or 17 may use the App with the permission of a parent or legal guardian.

A paid subscription must be purchased by someone aged 18 or over.

Because users aged 16 and 17 may access the App, KaddieIQ aims to apply appropriate privacy protections to younger users.

The current App is designed so that:

• there is no account, name or email requirement;
• there are no third-party advertisements;
• there are no advertising profiles;
• there are no analytics tools in the current build; and
• the answers you give stay on the device.

13. WHERE INFORMATION IS HELD#

KaddieIQ's core application database is hosted using Supabase in Ireland within the European Union.

Not every organisation involved in delivering the App necessarily processes all information solely in Ireland.

Apple, RevenueCat and other infrastructure providers may process certain information in other countries, including the United States, as part of their services.

Where KaddieIQ makes an international transfer of personal information that requires protection under UK data-protection law, we will use an applicable adequacy regulation or other appropriate legal safeguard as required.

14. HOW LONG WE KEEP INFORMATION#

We do not keep personal information for longer than reasonably necessary for the purpose for which it is held.

Anonymous player identifier and plan#

The anonymous player identifier and the plan record are kept while the identifier is in use and for as long afterwards as is reasonably necessary to administer a purchase, resolve a transaction or legal issue, or comply with law.

Subscription and purchase information#

Subscription information is retained for as long as necessary to administer your purchase and for any period for which retention is reasonably necessary to resolve a transaction or legal issue, or to meet accounting and legal obligations.

Course searches and your position#

We do not store the text you type into the course search or the position you send for “Courses near me”.

Security information#

Technical security information is retained only for as long as reasonably necessary for security, abuse prevention and related legal purposes, subject to the retention arrangements of the relevant infrastructure provider.

Information on your device#

Information stored on your device stays there until you delete the App or use Erase all my BallFIT data.

15. DELETING YOUR INFORMATION#

You can delete the information BallFIT keeps on your device at any time:

• by choosing Erase all my BallFIT data in the App (under Subscription and data, for Premium); or
• by deleting the App.

This removes your fits, history, preferences and optional details from your device. It does not delete the anonymous player identifier, which contains no personal information such as your name or email address, and it does not cancel any subscription.

If you would like us to delete the anonymous player identifier and plan record as well, contact privacy@kaddieiq.com (see section 17).

Important: Apple subscriptions#

Deleting the App or erasing your BallFIT data does not cancel an Apple subscription.

If you have an active Apple auto-renewable subscription, Apple may continue billing until that subscription is cancelled through your Apple Account.

You should cancel the Apple subscription if you do not want it to renew.

16. YOUR DATA-PROTECTION RIGHTS#

Under UK data-protection law, depending on the circumstances, you may have rights including:

• the right to be informed about how we use your information;
• the right to access personal information we hold about you;
• the right to correct inaccurate information;
• the right to request deletion of information;
• the right to restrict certain processing;
• the right to object to certain processing;
• the right to data portability in applicable circumstances; and
• the right to withdraw consent where processing is based on consent.

We may need to take reasonable steps to verify that a request relates to you before acting on it.

17. ANONYMOUS PLAYER IDENTIFIERS#

Because BallFIT does not ask for your name or email address, we may not hold anything that allows us readily to identify the person using a particular anonymous player identifier.

If you make a data-protection request, we may therefore need information that reasonably demonstrates which anonymous player identifier is yours, for example your Apple purchase receipt or order identifier.

We will not require more information than is reasonably necessary to identify the relevant record and deal with the request.

18. APPLE APP STORE PURCHASES#

Purchases made through the Apple App Store are processed by Apple.

Apple is responsible for handling the customer's App Store payment method and related billing process.

KaddieIQ and RevenueCat may process subscription or entitlement information necessary to determine whether paid functionality should be available to you.

For App Store refunds, billing history and subscription-management information, Apple also processes information under its own terms and privacy policy.

19. COOKIES AND LOCAL STORAGE#

The current App does not use cookies for advertising or analytics.

The App stores certain information locally on your device because that information is necessary or useful for App functionality, as described above.

20. AUTOMATED DECISION-MAKING#

BallFIT compares the answers you give with information about golf balls and gives you a recommendation and estimate.

This is guidance for your own decision. It does not produce legal or similarly significant effects on you, and KaddieIQ does not make solely automated decisions of that kind about you.

21. SECURITY#

We take reasonable technical and organisational measures designed to protect the information for which KaddieIQ is responsible against:

• unauthorised access;
• accidental loss;
• misuse;
• alteration; and
• inappropriate disclosure.

No internet-connected system can be guaranteed to be completely secure.

You should also take reasonable steps to protect access to your device and Apple Account.

22. CHANGES TO THIS PRIVACY STATEMENT#

We may update this Privacy Statement where necessary because of:

• changes to the App;
• new features;
• changes to service providers;
• legal or regulatory changes; or
• changes to our processing of personal information.

Where a change is material, we will provide appropriate notice where required.

The latest version will identify its last-updated date.
